Fees and terms of engagement

I publish my rates. You will know what a report costs before you instruct, and the invoice will match the figure agreed unless the scope changed and we discussed it first. Rates are the same whichever party instructs me.

Report fees

Published rates

Fees are quoted in writing on receipt of the letter of instruction and an indication of the volume of records, and confirmed before any work begins. Screening calls are always free, and rates are the same whichever party instructs.

Screening

Merits screening call No charge Up to 15 minutes on the papers you describe.
Written screening From £1,500 + VAT Short written view on whether the claim is arguable, on limited papers.

Full reports

Condition and prognosis report (personal injury) From £2,400 + VAT Records review, examination, report.
Breach of duty and causation report From £3,600 + VAT Position within the range depends on volume of records and number of issues.
Breach, causation and condition and prognosis From £4,500 + VAT

Follow-on work

Addendum report £2,000 + VAT Or charged at the hourly rate.

Records review and report preparation From £1,500 for simple screening, up to £6,500 for complex liability (without urgent reporting)

Scope

What’s included, and what’s charged separately

The report fee covers the report itself. Work that falls outside it is billed at the hourly rate above, and always agreed before it is undertaken.

Included in the report fee
  • Review of the records supplied.
  • Examination of the claimant, where required, at any of my clinical hospitals.
  • Preparation of the report and chronology.
  • Checking against the published checklist before release.
  • One round of clarification by email within 28 days.
Charged separately
  • Part 35 questions.
  • Conferences with counsel.
  • Experts’ meetings and joint statements.
  • Addenda following further disclosure.
  • Court and inquest attendance.
  • Travel outside London / the M25, charged per hour.
  • Pagination and indexing of an unpaginated bundle, where the firm is unable to supply one — always quoted before it is undertaken, never applied without agreement.

Payment terms

How and when invoices are paid

Invoice due Due on presentation, or according to the timeframe agreed in writing.
Contingency Fees are never contingent on the outcome of the claim. I do not act under any conditional fee arrangement, damages-based agreement or similar, and my fee does not vary with the result. This applies to every instruction, from every party.
Legal aid Not accepted.
VAT Registered. VAT number 462012337.
Deferred payment Where a firm requires it, payment may be deferred until the conclusion of the claim. Deferral affects only the date on which the invoice falls due — the fee is fixed at the point of instruction, is payable whether the claim succeeds or fails, and does not vary with the outcome or the level of damages recovered.

Conflicts

I check every instruction for conflict before accepting it. I will decline where I have treated the claimant, where a clinician whose care is in issue is someone I have a professional relationship with, or where I have already been approached by another party in the same matter.
